These Terms of Service ("Terms") govern your access to and use of the ArcNautical maritime intelligence platform ("Service") operated by ArcNautical ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

ArcNautical provides a maritime intelligence platform offering voyage risk scoring, fleet monitoring, threat intelligence, and alert services for maritime industry professionals. The Service aggregates publicly available data sources to generate risk assessments and intelligence products.

2. Account Registration

• You must provide a valid email address and create a secure password to register.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• One account per individual or organization. Multiple accounts for the same entity may be terminated.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service to violate any applicable law or regulation
• Attempt to reverse-engineer, decompile, or extract source code from the platform
• Use automated tools to scrape, crawl, or extract data from the Service beyond the provided API
• Share API keys or account credentials with unauthorized third parties
• Use the Service to facilitate or enable sanctions evasion
• Exceed your plan's rate limits or API quotas
• Interfere with or disrupt the Service's infrastructure

4. Service Tiers

The Service is available in multiple tiers (Starter, Professional, Enterprise), each with different feature sets, rate limits, and pricing. Specific tier details are provided at the time of subscription. We reserve the right to modify tier features with 30 days notice.

5. API Usage

• API keys are issued per account and must be kept confidential.
• API keys are hashed before storage; if lost, a new key must be generated.
• API requests are subject to rate limiting as described in your service tier.
• Webhook endpoints must accept HTTPS connections and validate HMAC signatures.

6. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

Specifically, we disclaim all warranties regarding:

• Accuracy: Risk scores, threat assessments, and intelligence products are computed from publicly available data sources and statistical models. They are intended as decision-support tools, not definitive risk determinations.
• Completeness: Data sources may be temporarily unavailable, incomplete, or delayed. The absence of a threat indicator does not guarantee safety.
• Timeliness: While we strive for real-time data, some signals have inherent latency (e.g., piracy reports may be delayed by hours or days).
• Weather Forecasts: Marine weather data is sourced from Open-Meteo with synthetic uncertainty modeling and should not replace official meteorological services.
• Sanctions Screening: Sanctions screening is provided as a due-diligence aid and does not constitute legal compliance advice. Users remain responsible for their own compliance obligations.

ArcNautical is not a substitute for professional marine surveying, legal compliance review, or official meteorological forecasting. Users should always exercise independent judgment and consult appropriate professionals for critical decisions.

7. Limitation of Liability

To the maximum extent permitted by law, ArcNautical shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of whether we have been advised of the possibility of such damages.

Our total liability for any claim arising from or relating to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

8. Intellectual Property

The Service, including its software, algorithms, scoring models, user interface, and documentation, is the intellectual property of ArcNautical. Your use of the Service does not grant you any ownership rights.

Data generated by the Service (risk scores, reports, assessments) for your account is licensed to you for your internal business use. You may share report outputs with your clients and stakeholders.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Termination

• You may close your account at any time by contacting us.
• We may suspend or terminate your account for violation of these Terms, non-payment, or extended inactivity (12+ months).
• Upon termination, your data will be retained for 30 days to allow export, then permanently deleted.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to your registered address at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
